Terms of Use
§ 1 Scope
These terms of use apply to the use of the website RETRO REWIND Database (hereinafter "Platform"). By registering and/or using the platform, the user accepts these terms of use in their respective valid version.
§ 2 Registration and user account
(1) Registration is required to use certain functions of the platform. The user is obliged to provide truthful information during registration and to keep it up to date.
(2) Each user may only create one user account. The user account is non-transferable.
(3) The user is responsible for the confidentiality of his access data. He is liable for all activities carried out under his user account.
§ 3 Usage rights and obligations
(1) The user receives a non-exclusive, non-transferable, revocable right to use the platform within the scope of these terms of use.
(2) The user undertakes not to misuse the platform. In particular, it is prohibited to:
• Upload content that violates applicable law
• Use the platform for commercial purposes without prior authorization
• Bypass or manipulate technical protection measures
• Perform automated access (bots, scrapers) without authorization
• Harass, threaten or discriminate against other users
§ 4 User content
(1) Users can upload their own content on the platform (e.g. movie ratings, comments, movie data). The user grants the operator a simple, temporally and spatially unlimited right of use to this content.
(2) The user warrants that the content they upload does not infringe any third-party rights and does not violate applicable law.
(3) The operator reserves the right to remove content without giving reasons.
§ 5 Virtual currency and store system
(1) The platform may contain a virtual store system with virtual currency. This virtual currency has no real monetary value and cannot be exchanged for real money.
(2) Acquired virtual goods and currencies are non-transferable and non-refundable.
§ 6 Liability
(1) The operator is fully liable for damages resulting from injury to life, body or health as well as for intent and gross negligence.
(2) For slight negligence, the operator is only liable for the violation of essential contractual obligations. Liability is limited in this case to the foreseeable, contract-typical damage.
(3) Liability for data loss is limited to the typical restoration costs that would have been incurred with regular and risk-appropriate backup copies.
§ 7 Termination and blocking
(1) The user can delete their user account at any time without giving reasons.
(2) The operator is entitled to temporarily block or permanently delete user accounts in the event of violations of these terms of use.
§ 8 Changes to the terms of use
The operator reserves the right to change these terms of use at any time. The user will be informed of changes in a timely manner. Continued use of the platform after the changes come into effect shall be deemed as consent to the amended terms of use.
§ 9 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) Should individual provisions of these terms of use be or become invalid, the validity of the remaining provisions shall remain unaffected.
(3) The place of jurisdiction is, to the extent legally permissible, Munich.
